Turf Delivery terms & conditions
1. General
These Terms & conditions shall apply to any order placed on Eco Sustainable Solutions via our turf on-line ordering sytem.

Definitions:
The company means Eco Sustainable Solutions
The customer means any person contracting with the company for the supply of goods
Delivery means delivery by the company or any sub-contractor employed by the company directly or indirectly
2. Supply of goods
Goods are supplied under the following express understanding:
(2.1) Contracts for the supply of goods to retail or domestic customers are covered by the Sale of Goods Act 1979 (as amended) and supplied in accordance with The Consumer Protection (distance selling) regulations 2000as amended by S1689 2005. This applies to retail/domestic customers only and NOT any trade customers or customers purchasing for resale.
2.2) Natural products vary and may not exactly reproduce as per theimages on our website. Additionally, there may be some limited variance in sizes quoted. Also, turf is a perishable product and must be properly laid within 12 hours of delivery. Furthermore, the customer is responsible for maintaining the product to ensure its’ appropriate development. The company will provide care instructions where requested.
2.3) Any complaint must be made within 24 hours of receipt of goods in writing via e-mail, fax or letter.
2.4) All total delivered prices include delivery to the UK mainland and VAT at the prevailing UK rate. All goods must be paid for in full by credit or debit card at time of placing order and before good are dispatched.
2.5) All turf shall be at the customers risk either upon collection by the customer or from the time of delivery. After such time the company shall be under no liability for loss or damage or deterioration of the turf under any circumstances.
2.6) Order amendments will be possible prior to the harvesting of the turf as long as they are made in writing via e-mail, fax or letter.
3 Delivery
3.1) Delivery will be made to the address designated by the customer and to the kerbside only. The customer or customer’s designated representative must be in attendance at the time of delivery, otherwise delivery will not be made and any additional charges incurred will be at the customers expense. These include (but not limited to) taking away, return to the company, redelivery and/or product disposal
3.2) The company will endeavour to deliver within the specified timescale but will not be held liable for any late deliveries howsoever caused.
3.3) The customer must ensure that there is reasonable and safe access for a large commercial vehicle at all times. Failure to ensure access may result in non-delivery and/or additional charges. If there is an access problem, this must be advised to the company at the time of order placement.
3.4) The company will not accept any liability for any loss, damage or injury howsoever caused in connection with any delivery.
3.5) The Company cannot be held responsible for failure to deliver due to any circumstance beyond its’ control including but not limited to weather, fire, explosions, industrial disputes, riots, embargoes, insurrection, war, civil unrest, delays in transport and terrorist action

Cancellations/returns policy
(4.1) Due to the perishable nature of turf, no returns will be possible. If the product is proved to be defective at the company’s liability, then the company will offer a replacement or refund at the company’s discretion.
4.2) Cancellations must be advised prior to harvesting of the turf. After this point, cancellation will only be at the discretion of the company and a refund will not be possible. If the cancellation is made prior to harvesting, then a full refund will be made, less an administration charge.
4.3) Cancellations can be only be made in writing by e-mail, fax or letter to the company’s correspondence address.

6.2) 6.1 applies in connection with the use of this website including if your use of this website results in the need for servicing, repari or correction of equipment, software or data, you assumes costs thereafter
6.3) You agree to indemnify us fully, defend and hold us, and our officers, directors, employees and agents, harmless from and against all claims, liability, damages, losses, costs(including reasonable legal fees) arising out of any breach of the Terms & Conditions by you, or your use of this website, or the use by any other person using your registration details.
